About Jurisprudence Interpretation and General Laws

 

The study of the science of law is known as Jurisprudence. The study of law in jurisprudence is not about any statute or a rule but of law in general, its concepts, its principles and the philosophies underpinning it. Interpretation is the act of analysing and understanding the meaning of any provision under the Law to find out the intent of Law. The necessity of interpretation arises where the language of a statutory provision is ambiguous. The ‘General Laws’ section introduces several important legislations that are essential to know for a CS student.

A Company Secretary is also a governance officer and supports the Board in keeping the compliance levels very high in the organisation. Therefore, having knowledge of jurisprudence, interpretation and essential basic laws of the legal systems of the country applicable to most organisations is a must for a Company Secretary. A Company Secretary should understand the legal principles and legal philosophy behind Law rather than just having knowledge of the Law and legal concepts. Further understanding of the statutes covered under ‘General Laws’ such as Civil Procedure Code, Criminal Procedure Code, Evidence Act, Stamp Act etc., provides solid ground for Company Secretaries either in employment or in practice.

The best approach to study Jurisprudence, Interpretation and General Laws is, 

  • Keeping yourselves updated with the changes in the body of Laws that include recent amendments, notifications, etc. that are applicable for your exam. That is, suppose you are studying for the June 2019 exam. Make sure you are up to date with all current legislation 
  • Make short notes and map key words in every paragraph and present your notes in a graphical manner to be able to revise in the easiest possible way before the exam  
  • Train you brain to re-call concepts as soon as you see the name of the topic. This is one of the best approaches to crack theory papers  
  • There are excellent books available on jurisprudence and interpretation of statutes. Please read them to have solid foundation for your profession
